Under New Hampshire law, any company or other non-municipal entity that “owns, operates, or manages” equipment for the “conveyance of telephone messages… for the public” is a telephone utility, and must be authorized by the Public Utilities Commission (PUC) to operate, with three notable limitations:
Companies that are not considered telephone utilities do not need, and cannot be granted, authorization by the PUC.
Companies that are listed below as ILEC (which stands for “Incumbent Local Exchange Carrier”) under “Local Service” must offer a limited-feature “basic service” telephone plan, with rates limited under state law until 2020. The ILEC companies are not required to file retail tariffs with the Commission.
*As of June 2015, all eleven ILEC’s in New Hampshire are registered as Excepted Local Exchange Carriers (see RSA 362:8). As a result, they do not maintain tariffs for retail telephone service with the Commission. Each ILEC must offer basic telephone service throughout its territory. |
